By accessing or using HVAC Bid Builder (“Service”), you agree to be bound by these Terms.

If you do not agree, do not use the Service.

HVAC Bid Builder is a calculation and estimation tool designed to assist HVAC professionals in generating cost estimates.

The Service does not provide engineering, financial, legal, or professional advice.

The Service is provided strictly as a tool.

All outputs are based entirely on user-provided inputs, assumptions, and configurations.

You acknowledge and agree that:

• You are solely responsible for all estimates generated
• You must independently verify all calculations

• You assume full responsibility for all business decisions

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND.

We expressly disclaim all warranties, including:

• Accuracy
• Reliability
• Fitness for a particular purpose
• Non-infringement

We do not guarantee:

• Correct calculations
• Profitability
• Code compliance
• Project feasibility

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

HVAC Bid Builder shall not be liable for:

• Financial losses
• Lost profits
• Business interruption
• Incorrect estimates
• Data loss

If liability is found, it is strictly limited to:

The total amount paid by you to the Service in the past 12 months, or $100 — whichever is greater.

You agree to defend, indemnify, and hold harmless HVAC Bid Builder and its owner from any claims, damages, or losses arising from:

• Your use of the Service
• Your estimates, pricing, or business decisions
• Any disputes with your customers
• Any misuse of the platform

If you create or use an account on behalf of a company:

• The company is fully responsible for all activity under the account
• The account owner assumes responsibility for all users
• We are not responsible for internal misuse, employee actions, or access issues

We are not responsible for:

• Data loss
• Corrupted data
• Failure to store or retrieve data

You are responsible for maintaining your own backups of critical information.

You are responsible for:

• Maintaining confidentiality of your login credentials
• All activity under your account
• 
  

We may suspend or terminate access at any time, with or without notice.

We may modify or discontinue any part of the Service at any time.

These Terms are governed by the laws of the State of Florida.

Any disputes must be resolved exclusively in Florida courts.

Before filing any legal claim, you agree to:

1. Contact us to attempt resolution
2. Allow 30 days for resolution

If unresolved, disputes will be handled through:

Binding arbitration or Florida courts (at our discretion)

These Terms constitute the entire agreement between you and HVAC Bid Builder.
